With this privacy policy, we would like to inform you about how we process personal data and inform you about your rights. We are aware of the importance of the processing of personal data for you as a data subject and accordingly observe all relevant legal requirements. The protection of your privacy is of utmost importance to us. The processing of your personal data by us is carried out in compliance with the General Data Protection Regulation, as well as the country-specific data protection regulations.

Definitions  

This privacy policy uses the terms of the General Data Protection Regulation (GDPR). 

"Personal data" means any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. 

"Processing" means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. 

"Restriction of processing" means the marking of stored personal data with the aim of limiting their future processing. 

"Profiling" means any type of automated processing of personal data that consists of using such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects relating to that natural person's job performance, economic situation, health, personal preferences, interests, reliability, behavior, location or change of location. 

"Pseudonymization" means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person. 

"File system" means any structured collection of personal data accessible according to specified criteria, whether such collection is maintained on a centralized, decentralized, or functional or geographic basis; 

"Controller" means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for by Union or Member State law. 

"Processor" means a natural or legal person, public authority, agency or other body that processes personal data on behalf of the Controller. 

"Recipient" means a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not a third party. However, public authorities that may receive personal data in the context of a specific investigative task under Union or Member State law shall not be considered as recipients; the processing of such data by the aforementioned authorities shall be carried out in accordance with the applicable data protection rules in accordance with the purposes of the processing.  

"Third party" means a natural or legal person, public authority, agency or other body, other than the data subject, the controller, the processor and the persons authorized to process the personal data under the direct responsibility of the controller or the processor. 

"Consent" means the expression of the will of the data subject, given voluntarily for the specific case, in an informed manner and unambiguously, in the form of a statement or other unambiguous affirmative act by which the data subject indicates that he or she consents to the processing of personal data relating to him or her.  

Processing operations  

We collect and process the following personal data about you:  

  • Contact and address information, if you have provided us with your contact information or  
    registered on our site,  
  • Customer account data as part of the ordering process,  
  • Online identifiers (e.g. your IP address, browser type and version, related operating system,  
    referrer URL, IP address, file name, access status, amount of data transferred, date and time of server request).  

Purpose  

We process your data for the following purposes:  

  • for the contact you have requested,  
  • for the processing of contracts, in particular for the processing of orders and invoicing,  
  • for advertising purposes,  
  • to send you the e-mail newsletter, provided you have signed up for it,  
  • for quality assurance and  
  • for our statistics.  

Legal basis  

The processing of your data is based on the following legal grounds:  

  • Your consent according to Art. 6 para. 1 lit. a) DSGVO,  
  • for the performance of a contract with you according to Art. 6 para. 1 lit. b) DSGVO,  
  • for the fulfillment of legal obligations according to Art. 6 para. 1 lit. c) DSGVO or  
  • from a legitimate interest according to Art. 6 para. 1 lit. f) DSGVO.  

Legitimate interests 

If we base the processing of your personal data on legitimate interests as defined by Art. Art. 6 para. 1 lit. f) DS-GVO, such interests are  

  • the improvement of our offer,  
  • the protection against abuse and  
  • the leadership of our statistics.  

Data sources  

We obtain the data from you (including about the devices you use). If we do not collect the personal data directly from you, we will also tell you the source of the personal data and, if applicable, whether it comes from publicly available sources.  

Recipients or categories of recipients of the personal data  

When processing your data, we work with the following service providers who have access to your data:  

  • Web analytics tools provider,  
  • Web hosting provider,  
  • Payment service provider,  
  • Transportation service provider,  
  • Social media platform providers,  
  • Advertising networks (for advertising insertions).

Storage duration  

We store your data:

  • If you have consented to the processing, at most until you revoke your consent and otherwise after the expiry of six months or after the expiry of the storage periods provided by law, 
  • If we need the data to perform a contract, at most for as long as the contractual relationship with you exists or statutory retention periods run, 
  • If we use the data on the basis of a legitimate interest at most as long as your interest in deletion or anonymization does not prevail.  

Your rights as a data subject .You have - partly under certain conditions - the right:

  • free of charge information about the processing of your data, as well as the receipt of a  copy of your personal data. Among other things, you can request information about the purposes of processing, the categories of personal data that are processed, the recipients of the data (if a transfer takes place), the duration of storage or the criteria for determining the duration;  
  • to correct your data. If your personal data is incomplete, you have the right to complete the data, taking into account the purposes of processing;  
  • Have your data deleted or blocked. Reasons for the existence of an erasure/blocking claim may be, among others, the withdrawal of consent on which the processing is based, the data subject objects to the processing, the personal data were processed unlawfully;  
  • to have the processing restricted 
  • object to the processing of your data;  
  • revoke your consent to the processing of your data for the future and 
  • complain to the competent supervisory authority about unlawful data processing.

If you subscribe to our free newsletter, your personal data provided during registration will be used to send you personalized newsletters about new products, valuable tips and news as well as exclusive offers. Product recommendations by e-mail  

Pursuant to Section 7 (3) of the German Unfair Competition Act (UWG), we are entitled to use the e-mail address provided when making a purchase in our store for direct marketing activities for our own similar products or services. If you no longer wish to receive our product recommendations, you can unsubscribe at any time. Data security  

We set up for each customer who registers accordingly, password-protected direct access to his inventory data stored with us (customer account). Here you can view data about your completed, open and recently shipped orders and manage your address data and newsletter. The transmission of this data at the following points is encrypted:  

* Login / * Customer account / * Shopping cart / * Order process.  

We secure our website and other systems through technical and organizational measures against loss, destruction, access, modification and distribution of your data by unauthorized persons. In order to protect your personal data from unauthorized access by third parties during transmission, we secure data transmissions using SSL encryption where necessary. This is a standardized encryption method for online services, especially for the web. You should always keep your access information confidential and close the browser window after visiting our website, especially if you share the computer with others.  

Order and contract text  

We save the contract text and send you your order details by e-mail immediately after receipt of your order. You can view the terms and conditions at any time here. If you are registered on the website, you can view past orders in your customer account. In our store you have the possibility to use different online payment methods. Your credit card data or account information is collected and processed directly by the respective payment service provider and is not stored by us. We do not receive any access to your payment information. You can find more details in the respective privacy policy of the payment service provider you have selected.  

Anti-Spam Policy  

Whyzzer does not tolerate spam. However, this does not mean that we can prevent spam on the Internet. If you think you have received an unsolicited email from us, please contact hey@whyzzer.com and we will investigate.  

Log files  

Each time our Internet pages are accessed, usage data is transmitted by the respective Internet browser and stored in log files, the so-called server log files. The data records stored in this process contain the following data: Domain from which the user accesses the website, date and time of access IP address of the accessing computer website(s) visited by the user within the scope of the offer, amount of data transferred, browser type and version, operating system used, name of the Internet service provider, message as to whether the access was successful. These log file data records are evaluated in anonymized form in order to improve the offer and make it more user-friendly, to find and correct errors and to control the utilization of servers.  

Cookies  

This website also uses so-called cookies. A cookie is a text file with an identification number that is transmitted to the user's computer and stored there together with the other data requested when the website is used. This storage helps us to design the website accordingly for you and makes it easier for you to use, for example, by storing certain entries you make so that you do not have to keep repeating them. As part of the Google Analytics advertising function, remarketing and reports on performance by demographic characteristics and interests are used. The purpose of these methods is to use the information about user behavior to align advertising measures more closely with the interests of the respective users. As part of remarketing, personalized advertising measures can be placed on other websites based on the user's surfing behavior on this website. In this context, the advertising materials may contain products that the user has previously viewed on the website. Google Tag Manager 

This website uses the Google Tag Manager, a service of Google Inc. ("Google"). For the European area, the company Google Ireland Limited (Gordon House, Barrow Street Dublin 4, Ireland) is responsible for all Google services. Google Tag Manager is a solution that allows marketers to manage website tags through one interface. Google Ads Conversion 

We use the Google Ads Conversion offer to draw attention to our offer with the help of advertising media (so-called Google Ads) on external websites. We can determine how successful the individual advertising measures are in relation to the data of the advertising campaigns. In this way, we pursue the interest of showing you advertising that is of interest to you, making our website more interesting for you and achieving a fair calculation of advertising costs. 
These advertisements are delivered by Google via so-called "ad servers". For this purpose, we use ad server cookies, which can be used to measure certain parameters for measuring success, such as display of the ads or clicks by users. We have no influence on the scope and further use of the data collected by Google through the use of this tool and therefore inform you according to our state of knowledge: Through the integration of Ads Conversion, Google receives the information that you have called up the corresponding part of our website or clicked on an ad from us. Google Ads Remarketing 

We also use the remarketing function within the Google Ads service. With the remarketing function, we can present users of our website with advertisements based on their interests on other websites within the Google advertising network (in Google Search or on YouTube, so-called "Google Ads" or on other websites). Facebook, Custom Audiences, and Facebook Marketing Services  

Insofar as you have given your consent (Art. 6 para. 1 lit. a DSGVO), the so-called "Facebook pixel" of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are a resident of the EU, Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, is used on this website for the analysis, optimization and economic operation of our online offer. 

With the help of the Facebook pixel, it is possible for Facebook to determine the visitors to our online offer as a target group for the display of ads (so-called "Facebook ads"). Criteo  

Insofar as you have given your consent (Art. 6 para. 1 lit. a DSGVO), the Criteo service of Criteo SA, Rue Blanche, 75009 Paris, France (http://www.criteo.com/de) is used on this website. With the help of this service, users who have already visited our website and are interested in our offers are offered targeted advertisements on this website and on websites that also use the Criteo service.
